Berea Planning Commission to mull cannabis dispensary zoning – cleveland.com

A draft ordinance establishing proper zoning for a dual-use cannabis dispensary in Berea has been referred to the city's Planning Commission.
BEREA, Ohio — A draft ordinance instituting proper zoning language to permit one adult-use cannabis and medical marijuana dispensary in Berea has been referred to the city’s Planning Commission.

It is the next step in establishing an appropriate area within the West Bagley Road Commercial District (BR-CD) for such a business to operate.
City Council made the referral during its June 3 regular meeting.

Council members first began discussing cannabis business restrictions four months ago, later banning cultivating and processing operations but allowing one dispensary.

Law Director Barbara Jones, at a special May 13 meeting, said a dual-use dispensary could possibly go in any of six zoning districts under a conditional use.
But council members want to restrict it to just the West Bagley Road Commercial District.

It is anticipated that the proposed zoning ordinance will appear on the July 18 Planning Commission agenda.

Council President Jim Maxwell extended his appreciation to Jones and Clerk of Council Alycia Vale for working overtime to get the latest, simplified version of the draft ordinance into council’s hands.

“The July 18 Planning Commission meeting is the 45-day window in which they have to hear it,” Maxwell told council.

Mayor Cyril Kleem and Planning Commission Chairman Matt Madzy had made a written request to council, upon the referral, to extend the commission an additional 15 days (for a total of 60 days) to review the legislation, but council did not grant that request.

“I just feel 45 days is a reasonable amount of time … given my professional experience with various title companies and different people dealing with real estate,” Councilman Chris McManis said.
“I don’t think the Planning Commission needs an additional 15 days.”
